Donald Trump has announced plans to roll back protections for transgender people (Pictures: AP) Donald Trump’s administration has overturned health protections for transgender people on the anniversary of the Pulse nightclub massacre. The US Department of Health and Human Services announced Friday it will now enforce sex discrimination laws ‘according to the plain meaning of the word “sex” as male or female and determined by biology.’ That saw broader protections created by Trump’s predecessor Barack Obama scrapped. The Obama-era rules ordered that people should also be protected from sex discrimination if they were transgender, and had an internal sense of being male, female, neither, or a combination of both genders. Trump’s scrapping of those protections was blasted by LGBT rights groups, who say it will cause further harm to transgender people seeking gender confirmation treatment, and make it more difficult for them to get treatment for other common illnesses. American Medical Association president Dr Susan Bailey was among those who criticized the new rule. Trump’s new guidelines were announced on the fourth anniversary of the Pulse nightclub massacre, which saw gunman Omar Mateen murder 49 at the Orlando LGBT venue (Picture: AP) She said: ‘The federal government should never make it more difficult for individuals to access health care — during a pandemic or any other time.’ The president’s team has defended the move by saying Obama overreached his legal authority to define the terms sex and gender. They made the announcement four years to the day after homophobic gunman Omar Mateen opened fire at Pulse nightclub in Orlando, killing 49 people who were attending the LGBT venue. Under the Obama-era rule, a hospital could be required to perform gender-transition procedures such as hysterectomies if the facility provided that kind of treatment for other medical conditions. The rule was meant to carry out the anti-discrimination section of the Affordable Care Act, which bars sex discrimination in health care but does not use the term ‘gender identity.’ Mary Beth Waddell from the Family Research Council is among those who support the Trump administration’s new rule. She said: ‘Under the old Obama rule, medical professionals could have been forced to facilitate gender reassignment surgeries and abortions — even if they believed this was a violation of their conscience or believed it harmful to the patient. But House Speaker Nancy Pelosi – one of Trump’s most vocal critics – disagreed, saying: ‘Religious freedom is no justification for hatred or bigotry, and every American has the right to seek and receive care without intimidation or fear.’ Trump’s ruling already faces legal challenges, with the American Civil Liberties Union already moving to try and stop protections for trans people being rolled back. LGBT civil rights group Lambda Legal also plans to sue. . Head of the Department of Health and Human Services Roger Severino helped push the new rule, and claims transgender Americans will still be afforded protection by other anti-discrimination laws. He said: ‘Everyone deserves to be treated with respect and according to the law. Our dedication to our civil rights laws is as strong as ever.” President Trump became the first Republican presidential nominee to hold up a pride flag during his campaign, and vowed to protect LGBT Americans. But since coming to power he has repeatedly took aim at the transgender community. Shortly after his inauguration in 2017, he banned trans men and women from serving openly in the US military, claiming their medical treatments were a ‘burden’ on Pentagon budgets.
